Emergency incidents

An emergency incident regarding the pollution of water resources, includes any incident or accident in which a substance pollutes or has the potential to pollute a water resource or has or is likely to have a detrimental effect on a water resource. The person responsible for the incident or the substance involved is responsible for remedying of the situation. The action to be taken includes to contain and minimize the effects of the incident to all reasonable measures, to undertake clean-up procedures, to remedy the effects of the incident and to take any actions the catchment management agency direct either verbally or in writing. The responsible person includes any person who is responsible for the incident, own the substance or was in control of the substance involved in the incident at the time of the incident. The responsible person, any person involved, or any person with knowledge of the incident, must as soon as reasonably practical after obtaining knowledge of the incident, report to the Department and the South African Police Service or the relevant fire department or the relevant catchment management agency. The catchment management agency may take remedying measures it considers necessary, should the responsible person fail to comply or inadequately comply timeously. (20)
